Limited-Duration Rules
Under state law, retired members may return to work for a SCERS-participating employer only for a limited duration and under specific conditions.
In most cases, you may work for up to 36 months, starting on the first day you actually begin working (not your hire date). During this time, you may work no more than 960 hours per year, and only hours you actually work count toward this limit.
In some situations, your employer may approve up to two additional 12-month extensions, allowing you to work beyond the initial 36 months. These extensions must be approved by the employer’s chief executive (or the director of the County Department of Personnel Services) and may be granted for business or workforce needs. Additional extensions may be available for retirees working in public safety positions.
Employers are responsible for monitoring hours, duration, and compliance reporting to SCERS; however, it’s also important for members to follow these limits carefully. Working more hours than allowed, or working beyond the approved time period, can result in repayment of retirement benefits and possible suspension of your benefit.
